Placing any our works in the Internet, each of us pursues certain purposes, the achievement of which becomes sometimes impossible because of infringement of our copyright. In fact, any published and unpublished work, existing in any objective form (written, oral, audio, video, image or three-dimensional) and in which creation you have enclosed your creative work, automatically becomes your intellectual property and is protected by the Law of The Republic of Belarus №02-43/777 from 30.03.2010 “About the copyright and the adjacent rights” (further – the Law). And this is not the joke, since a certain number of penalties is provided for the copyright and the adjacent rights infringement.
Measures of the civil-law responsibility for the copyright and the adjacent rights infringement are determined in Article 40 of the Law. So the legal owner has the right to demand:
recognition of the copyright and the adjacent rights;
restore the situation existing before the copyright and the adjacent rights infringement;
suppression of actions violating the copyright and the adjacent rights or threatening their violation;
the indemnification, including the missed benefit;
collecting revenue received by the infringer owing to the copyright and the adjacent rights infringement, instead of indemnification;
payment of compensation in the amount of 10 to 15 thousand basic units, determined by the Court, instead of the indemnification or collecting revenue, taking into account the substance of the offense;
acceptance of other measures, provided for by legislative acts, and relating to copyright and the adjacent rights protection.
The administrative responsibility for the copyright and the adjacent rights infringement is determined by Article 9.21 of the Code of The Republic of Belarus on Administrative Offences according to which illegal distribution or illegal use of the objects of the copyright, adjacent rights or objects of rights of industrial property attracts imposing a fine on a body corporate up to three hundred basic units with confiscation of the subject of an administrative offense or without confiscation.
The criminal responsibility for the copyright and the adjacent rights infringement is determined by Article 201 of the Criminal Code of The Republic of Belarus. According to this Article illegal distribution or other illegal use of objects of the copyright, adjacent rights or objects of rights of industrial property committed within one year after imposition of administrative penalty for the same infringement or connected with the reception of the income on a large scale is punished by public works or the fine, or restriction of freedom for the term up to three years, or imprisonment for the term up to two years.
As you see, all is serious, and of course, it is undesirable to get in such situation.
Therefore, dear reader, I would like to warn you against unnecessary problems. The Internet is full of announcements that offer the creation of cheap sites for 100, 200 or 300$ that will be ready within 2- 4 days. Be cautious with such announcements. In fact, it takes about a month to create a professional site, and no self-respecting web designer will undertake such work for 300$. For this sum he can only offers you a site created on the basis of the ready template which in 99% is carried out not by this web designer but “is borrowed” somewhere in the Internet. Templates created by the web designer cost a little bit more cheaply that the creation of the site from the very beginning. Therefore, when you sometimes are offered a ready template of a site, take an interest, who has created this template, and whether you will find the same site as yours in the Internet. When you become the owner of someone else`s template site, there can occur an unpleasant situation. If the real creator of the site template will see your site, he can charge you in infringement of his copyright and demand compensation for damage according to the Laws of our country (see above).
So I`d like to give you advice – a site is your card in the Internet, your second office, your advertisement and your image! It is your reputation, and if you have spoiled it once, then it will be difficult to retrieve your character again.
Deal only with professional web studios and get a qualitative product which can adequately present you in the global market of goods and services. And remember – the disappointment because of bad quality lasts much longer than the pleasure because of cheap price.
